Miro Prek, PhD, LL.M., is an international legal expert and transformation specialist, facilitating transformation of organisations, businesses and individuals. In addition to serving as the Chair of the Board of Appeal at ACER, he is working on various high-level projects that require strategic approach, involvement of stakeholders and development of new ways of handling disputes in a more collaborative way.

2004-2019

Immediately preceding his career as an independent international legal expert, dr. Prek worked as judge (2006-2019) at the General Court of the European Union. His peers elected him president of chamber twice (2013-2016, 2016-2019). In performing his mandate, he was privileged to work on some of the most interesting cases in the areas of competition law that led to developing a specialised expertise in business and particularly financial law: with cases such as cartels in the area of interest rate fixing to cases of judicial control in the area of EU banking law. In the last years as judge, dr.Prek specialised in the EU banking law (cases involving major European banks against the ECB, mostly in the area of the Single Supervisory Mechanism, and to a lesser extent in the area of the Single Resolution Mechanism).

His academic and research activities consist of lecturing at the international conferences and universities, as well as of publishing (as co-author) several well received articles on EU law (General Court as the EU competition court; EU courts as national courts; margins of appreciation, power of appraisal; state aid; control of ECB's activities in banking supervision), published in the leading legal journals.

Miro Prek started his career in the early 90s in Slovenia, when the country had just declared its independence. Having worked in the legal service of the government, the challenge was enormous: a new legal system had to be created almost ex nihilo and an entire society had to be transformed. Miro actively participated in the negotiations for membership with the EU from the very beginning: first for the Europe Agreement (1996), then for the Accession Treaty (1998-2003) as member of the Core Negotiating Team; he also had various responsibilities in preparing the country for membership as a follow-up to negotiations.

After the end of accession negotiations, Miro advised governments and their services on EU law as an independent legal expert, team leader and senior legal expert in EU financed projects.
An important part of his activities is providing legal expertise in substantive EU law, especially the EU banking law, but also competition, public procurement, and other areas of law; in recent years, Miro is intensely involved in climate change and energy transitions.

In complement to his legal profile, Miro is also a certified executive and team coach (Marshall Goldsmith Stakeholder Cantered Coaching, GTCI, GCG), arbitrator and expert in trade and sustainability leadership (EU Commission, Cambridge Institute of Sustainability Leadership).

Miro is a member of the Chartered Institute of Arbitrators (CIArb, London), of the Luxembourg Arbitration Association (LAA, Luxembourg), of the Silicon Valley Arbitration and Mediation Center (SVAMC, Palo Alto, California) and of the Luxembourgish Association of Banking Law Lawyers (ALJB).

In complement to his legal profile, Miro is also a certified executive and team coach (Marshall Goldsmith Stakeholder Centered Coaching, GTCI, GCG), arbitrator and expert in trade and sustainability leadership (EU Commission, Cambridge Institute of Sustainability Leadership).

  • LITIGATION – ADR/CDR – NEGOTIATIONS
    Former EU judge, at home in the various procedures before the EU courts, as well as EU institutional and procedural settings.

    In addition to the »hard« dispute resolution, Miro is increasingly involved in less traumatising, friendlier, quicker and cheaper ways of solving the disputes, especially through arbitration and other alternative (collaborative) means of dispute resolution, as well as negotiations.

    Complex and lenghty processes of negotiations for accession to the EU, with and within EU instiutions, were an enlightening learning process.

  • COACHING
    Accompanying my partners in their challenging times towards a better professional and personal lives.
    In coaching, there are methods and techniques (Marshall Goldsmith for individuals and teams, as well as GTCI), but essentially there is a relationship, based on trust, reinforced by a shared vision and successful development as a result of working together in a committed, yet playful way.
    At any time, I work with three partners at the most so as to guarantee a dedicated and personalized experience.
